Terms of use

The ERODE trademark has been registered with the INPI and the products developed by ERODE are protected by patents.

The present terms and conditions determine the conditions of use of the Site.

Article 1 – Access to the Site

The Client, like any user, and ERODE recognize that the internet is an open network, comprising international connections between computer networks. Computer networks may have different transmission capacities and their own usage policies. No one can guarantee the correct functioning of the internet as a whole.

Access to the Site offered by ERODE is possible 24 hours a day and 7 days a week, except in cases of force majeure or an event outside the control of ERODE and its technical service providers, and subject to possible outages and maintenance interventions necessary to ensure the correct functioning of the Site.

ERODE can not, under any circumstances, be held responsible for the availability of their Site due to failures or malfunctions of the internet network.

Likewise, ERODE can not be held responsible for any interruption of the online services available on the Site when it must temporarily interrupt access to all or part of its Site to resolve a technical issue or to further develop it.

By using the Site, each user accepts the Site's terms of use – namely the Legal Notices and Terms of Use – without reservation, modification, or limitation.

In the event of any changes or updates, the revised Terms of Use will be published online on the Site with a mention of the date of the last update. It is the responsibility of the user to regularly check the Site to stay informed of any changes or updates to the Site's Terms of Use.

Article 2 – Purpose of the Site

The Site exists to provide users with information regarding ERODE's products, services, and activities. The Site does not permit the online sale of products or services.

The Site and data, information, and documents it contains are only intended to provide general, non-exhaustive information. Each user is solely responsible for any use they make of the Site's content and/or the information provided on the Site and ERODE can not, under any circumstances, be held liable for any direct or indirect damages resulting from the user's use of the Site and/or the information it provides.

ERODE also can not be held liable for damages resulting from a fraudulent intrusion by a third party leading to modification of the information provided by the Site.

ERODE insures that the Site does not contain any hypertext link permitting direct or indirect access to sites or pages of sites whose content violates laws and regulations.

Article 3 – Intellectual Property

The Site and all the elements contained within, notably the text, articles, information, reports, presentations, brochures, illustrations, software programs, and animations, are the exclusive property of ERODE. The user is not authorized to reproduce, present, modify, translate and/or adapt, in whole or in part, for profit or free of charge, the Site or any element it contains, nor reproduce and/or present such translations, adaptations, or changes, in whole or in part, for profit or free of charge, without the prior written consent of ERODE.
As an exception, ERODE authorizes users to download to the hard drive of their personal computer any newsletters or other documents that are the property of ERODE which are made available as digital files specifically for the purpose of being downloaded.

In this case, and unless otherwise expressly reproduced on each of the above documents, the user will be authorized to keep a copy of these documents, and to print and share them, provided they do not make any changes to said documents.

ERODE retains all moral and economic rights to all of the Site's content.

Article 4 – Data Protection – Personal Data

ERODE undertakes to respect the requirements of French Law n°78-17 of January 6th, 1978 and the European General Data Protection Regulation (EU) 2016/679 relating to information technology, files and civil liberties.

The Site has been declared to the CNIL.

Any personal information that may be collected by the Site is principally used by ERODE to manage relations with Site's client or user.

It is saved in the ERODE client file created from data of a personal nature which is declared to the CNIL.

Users have the right of access, inquiry, modification and deletion of information concerning them, which may be exercised at any time by contacting ERODE either directly through the "Contact Us" section of the Site or by postal mail or email to the addresses mentioned above in Legal Notices. This request must be accompanied by a proof of identity. After processing the request, this proof will be destroyed before the specified deadline.

Data pertaining to ERODE, its legal representative, or its teams which is made available on the Site may not be collected nor processed without the prior written consent of the concerned party. In particular, each user agrees not to collect and use, either manually or automatically, this data to send messages of an advertising or any other nature.

Article 5 – Cookies

In order to provide users with optimal navigation on the Site as well as improve the operation of various interfaces and applications, ERODE may install a cookie on the user's computer.

Cookies make it possible to store information relating to navigation of the Site (date, page, time), as well as data the user may possibly enter during their visit to the Site (searches, login, email, password). These cookies are intended to be kept on the user's computer for a variable duration which may not exceed one year and may be read and used by ERODE during subsequent visits to the Site.

All indirectly collected information will only be used to track the volume, type, and configuration of traffic using the Site in order to improve its design and functionality and for other administrative and scheduling purposes, and more generally to improve use of the Site.

The user has the ability to block, change the expiration of, or delete these cookies via their browser interface. In this case, navigation on the Site will not be optimized. The user also has the ability to delete the cookies installed on their computer by going to the menu provided for this purpose within their browser. By doing so, the user will lose the benefit of these cookies.

Article 6 – Changes to the Terms of Use

ERODE may modify the present terms of use at any time.
